Several other vehicles stopped to help the boys.  The driver, who hit them, said he did not see them in the crosswalk.  The boys were seriously injured and taken to a nearby hospital for treatment.  The driver was not injured.

A 24-year old woman trying to cross the street in Ontario the other evening was injured by a hit-and-run driver.

Reports indicate that the woman was not crossing in a crosswalk when the accident occurred.  Pedestrians are always urged to use a crosswalk, especially when crossing a busy street; they are jeopardizing their safety when they do not.

California Vehicle Code Section 21954 states, “Every pedestrian upon a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles upon the roadway so near as to constitute an immediate hazard.”

She was taken to a nearby hospital where she is listed in critical condition.

If you have been injured in a pedestrian accident while crossing outside a crosswalk, you may still be able to receive compensation for your injuries from the careless driver.  Contact an experienced San Bernardino Personal Injury attorney who can discuss your legal options with you.

A 22-year old Victorville man was struck the other night by, not one, but several cars.

The young man was crossing Highway 18 in Apple Valley when several vehicles heading west crashed into him, causing the highway to be closed for several hours.

According to the San Bernardino Coroner’s office, he was pronounced dead at the scene. Reports indicate that a second man was taken to a nearby hospital with injuries. However, it is unclear if the two men were walking together.

According to California Vehicle Code Section 21956 (b), “A pedestrian may walk close to his or her right-hand edge of the roadway if a crosswalk or other means of safely crossing the roadway is not available or if existing traffic or other conditions would compromise the safety of a pedestrian attempting to cross the road.”

Even though most people drive to wherever they are going in San Bernardino County, there are still those that walk.  Most pedestrians know to cross at a crosswalk.

There are specific laws in place that governs who has the right of way.  If one party violates these laws, he or she would probably be found negligent.  One of the most common causes of pedestrian accidents involves drivers who fail to yield the right-of-way to pedestrians.

California Vehicle Code Section 21950 states, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.”  It continues with, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.”

If you or someone you love is injured as a result of the negligence of a motorist, contact an experienced San Bernardino Personal Injury attorney who has been successful in fighting for the rights of injured pedestrians and will work aggressively to make sure you are compensated for your medical costs, pain and suffering and any other expenses incurred.
