Even though most people drive to wherever they are going in San Bernardino County, there are still those that walk. Most pedestrians know to cross at a crosswalk.
There are specific laws in place that governs who has the right of way. If one party violates these laws, he or she would probably be found negligent. One of the most common causes of pedestrian accidents involves drivers who fail to yield the right-of-way to pedestrians.
California Vehicle Code Section 21950 states, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” It continues with, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.”
If you or someone you love is injured as a result of the negligence of a motorist, contact an experienced San Bernardino Personal Injury attorney who has been successful in fighting for the rights of injured pedestrians and will work aggressively to make sure you are compensated for your medical costs, pain and suffering and any other expenses incurred.

Occasionally, a big-rig driver can lose control of his rig because of shifting or falling cargo.
It is possible for building products to fall off a tractor trailer or bulldozers, front-end loaders, or any type of heavy equipment in transport to break from their moorings – all resulting in a devastating accident.
When a tractor-trailer jackknifes because of shifting cargo, innocent motorists close by can be injured. Truck drivers must abide by the Federal Motor Carrier Safety Regulations which specify how a large truck’s load must be contained, secured and immobilized. By following these rules, the truck’s stability and maneuverability are not affected. A trucker is not allowed to operate a commercial vehicle unless the vehicle’s cargo is properly distributed and secured according to federal regulations.
If you are involved and injured in an accident with a big-rig that was caused because the cargo was not properly secured, contact a San Bernardino Personal Injury attorney who has handled cases involving big-rig trucks. This may constitute negligence and serve as the legal basis for you to file a personal injury lawsuit against the trucking company and its driver.

The headlines are filled with horrific big-rig accidents every day. Many of them have resulted from fatigued or overworked drivers – some actually falling asleep behind the wheel.
Because truck drivers drive too many hours in a day, they tend to be overtired, causing them to also become negligent in their driving and driving in violation of a federal hours-of-service regulation. Unrealistic expectations have caused thousands of truckers to lose control, causing deaths of innocent people.
Drivers in California, along with all states, must follow minimum rest and maximum work requirements every day in a specific work period. Even with specific rules, truckers can work up to 70 hours a week in order to ensure their cargo reaches the destination on time.
California law requires all truck drivers to follow:
· Driving a maximum of 11 consecutive hours at one time
· A maximum of 14 consecutive on-duty hours
· A minimum of 10 consecutive off-duty hours between driving shift
If you are involved in an accident with an overtired or negligent trucker, contact a San Bernardino Personal Injury attorney who has handled successful cases involving truck drivers.

Most people are taught at a very early age to look both ways before crossing the street.
Still, many accidents happen between an automobile and a person on foot. When this happens, the victim has absolutely no protection and absorbs the full impact of the collision.
As a result, a pedestrian accident can be very devastating, leading to life-altering injuries or death.
According to the National Highway Traffic Safety Association, approximately 5,000 pedestrians die in motor vehicle accidents every year in the United States. In addition, more than 70,000 pedestrians endure severe injuries when struck by an automobile.
If you have sustained injuries while crossing the road on foot, contact a San Bernardino Personal Injury attorney who will protect your rights and have your best interests in mind.

A National survey released by the National Highway Traffic Safety Administration reports that in spite of all the legal bans, texting by drivers keeps increasing, especially among younger motorists – ages 21 through 24.
The survey goes on to say that many drivers don’t think it’s dangerous when they do it – only when others do. Apparently the new laws have not discouraged motorists from texting or using their cellphones while driving. At any given moment, there is someone who is texting, emailing, surfing the Web or otherwise using a hand-held electronic device.
The survey goes on to report that in 2010 more than 3,000 deaths on the highways were caused by driver distraction, including eating while driving and thumbing emails.
Let’s hope the New Year includes abiding by the rules because the life you save may just be your own. If you are or someone you love is injured in an accident caused because of driver distraction, contact an experienced San Bernardino Personal Injury attorney who will fight for and protect your rights.
