A 20-year old man was a passenger in a vehicle driven by a suspected drunk driver early the other morning in Chino.

 

It was reported that the 22-year old driver crashed into an embankment, killing one of his three passengers.  The other passengers, a 19-year old woman and a 16-year old girl were taken to a nearby hospital with major injuries.

 

California law states that it is illegal to operate a motor vehicle while under the influence of alcohol and/or drugs.  California Penal Code Section 191.5(a) states, “Gross vehicular manslaughter while intoxicated is the unlawful killing of a human being without malice aforethought, in the driving of a vehicle, where the driving was in violation of Section 23140, 23152, or 23153 of the Vehicle Code, and the killing was either the proximate result of the commission of an unlawful act, not amounting to a felony, and with gross negligence, or the proximate result of the commission of a lawful act that might produce death, in an unlawful manner, and with gross negligence.”

 

The driver was arrested on suspicion of felony DUI and gross vehicular manslaughter.

A 53-year old man was arrested by San Bernardino County Sheriff’s Department officers recently on suspicion of driving while under the influence and child endangerment.

 

The man was driving down a street in Yucaipa when he lost control of his vehicle causing him to drive over the curb and 40 feet of chain link fencing.  Once he regained control, he continued on, dragging about 35 feet of support tubing from the fence with him.  The tubing pierced the driver’s 17 year-old son’s shoulder; he was sitting in the front seat.

 

Witnesses called for help when they saw the fencing and tubing hanging from the vehicle.  It took firefighters about 20 minutes to rescue the boy from the vehicle.  He was taken to a nearby hospital by paramedics.

A 38-year old Upland man was hit by a vehicle in Ontario the other evening while on his motorcycle. He was taken to a nearby hospital where he died several hours later.

 

Police arrested a 32-year old man on suspicion of felony driving under the influence of alcohol, which caused this fatal accident.  He was also charged with child endangerment since there were two small children, ages 3 and 5, in the back seat of his vehicle.

 

The accident happened as the vehicle was turning left – he collided into the motorcycle.

A 20-year old man was killed almost a year ago by a driver driving under the influence of alcohol.  The 34-year old intoxicated driver from Pomona collided with the victim’s car while he was stopped on Interstate 60.

 

Recently, the man pleaded guilty to vehicular manslaughter as part of a plea agreement.

 

It carries a sentence of one year in jail, which the victim’s family felt was too short.  The court explained that the driver has no prior criminal history, he expressed remorse and he will make restitution payments to the family of the victim.

   

When police measured the 34-year old driver’s blood alcohol content, it was 0.07% - just a little less than the legal limit of 0.08%.  The victim had also been drinking.  It is believed he may have fallen asleep at the wheel.

I cannot tell my clients, family and friends enough times that drinking and driving is a bad idea and could prove to be fatal as it did this past weekend for a 32-year old Hesperia man.

 

The San Bernardino County Sheriff’s department believes that alcohol may have played a role in the death of a man who crashed his truck into a drainage channel in Victorville recently.  He lost control of his vehicle as he drove around a curve in the road.

 

An individual that was passing by in the early morning hours discovered his body. The man was pronounced dead at the scene.

A 60-year old bicyclist died two weeks after being hit by a vehicle in Ontario.  The man was attempting to cross a major intersection when a Volkswagen struck him.

 

The police are investigating to determine who was at fault.  They are checking to see if the driver of the vehicle was negligent in any way, such as driving under the influence or speeding.  California Highway Patrol records show that a few years ago, 27 people were injured in bike accidents in Ontario and bike accidents claimed the lives of eight people in San Bernardino County.

 

California Vehicle Code Section 21650 states, “Upon all highways a vehicle shall be driven upon the right half of the roadway.” According to Subsection (g), “This section does not prohibit the operation of bicycles on any shoulder or a highway, on any sidewalk, on any bicycle path within a highway, or along any crosswalk or bicycle path crossing, where the operation is not otherwise prohibited by this code or local ordinance.”

Can you believe it’s been almost a month since a 47-year old Ontario man driving a Mercedes drove into a coned-off construction zone and hit an earth-moving machine on the San Bernardino Freeway?  His actions killed a 20-year old woman and injured five other people.

 

According to California Highway Patrol, the 47-year old man was arrested on suspicion of driving under the influence of alcohol and/or drugs and vehicular manslaughter.  It seems the freeway’s two right-hand lanes were marked for construction when the driver veered into them, hitting a stationary machine and worker on it.

 

The worker was taken to a nearby hospital with injuries.  The Mercedes had six people in it; five were hospitalized with minor to major injuries.  One 20-year old woman died from injuries sustained.

Many of my friends and clients spend the holiday season in Las Vegas.  I want to urge you to take caution when you are on the stretch of Interstate 15 - beginning in San Bernardino County and ending in Clark County, Nevada.  It is not only one of the busiest roads in the United States, but also one of the most dangerous.

According to the Las Vegas Convention and Visitors Authority, more than eight million drivers come across that road every year, causing more fatalities than any other road in the country, let alone California.  The Auto Club suggests that speeding is the number one problem, followed by drinking and inattentiveness.  In addition, motorists need to wear their seatbelts at all times.

I know you are in a hurry to get to Las Vegas, but I urge you to observe the speed limit and look all around you, especially on that specific stretch of road.  The life you save may be your own.

The San Bernardino County Sun recently reported that a young man, 20 years old, was walking on Eucalyptus Avenue in Chino Hills when an SUV hit and killed him.

 

California Highway Patrol is investigating the cause of this tragic accident.  They are trying to determine if the young man was walking in the roadway or in a crosswalk.  The investigation will determine if the driver was under the influence of alcohol and/or drugs or if he was distracted or speeding.  They reported that in 2008 in San Bernardino County about 40 people died and over 400 were injured because of pedestrian accidents.

 

I ask that you keep the family of this young man in your thoughts and prayers.

California Highway Patrol reported that a 21-year old Bakersfield man, a passenger in the car, was killed in the desert town of Trona recently.  Police believe the driver may have been drunk when he crashed the car going around a sharp curve at an unknown speed; he lost control of the vehicle and it overturned at least once.

 

The driver was arrested for possible driving under the influence of alcohol.  The accident was not discovered for over three hours due to no cell phone coverage in the area.

 

My heart goes out to the family of this young man who was killed.
