Did you know that your insurance company offers underinsured motorist coverage? What is that, you ask? California law requires all drivers to carry at least a minimal amount of liability insurance in order to operate a vehicle legally. However, not all drivers comply with this law.
Underinsured motorist coverage is an option and protection offered to you that covers you for property damage and bodily injury caused by another motorist who does not have sufficient coverage to pay for the damages he or she caused to you. The insurance compensates you for the difference between the injury suffered and the liability covered by the at-fault driver’s insurance company.
If you suffered a serious injury in an accident and you have concerns that the responsible party does not have enough liability insurance to cover your damages, contact an experienced San Bernardino Personal Injury attorney who has the answers you need to move forward with assisting you on your possible underinsured motorist claim.

Even though most people drive to wherever they are going in San Bernardino County, there are still those that walk. Most pedestrians know to cross at a crosswalk.
There are specific laws in place that governs who has the right of way. If one party violates these laws, he or she would probably be found negligent. One of the most common causes of pedestrian accidents involves drivers who fail to yield the right-of-way to pedestrians.
California Vehicle Code Section 21950 states, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” It continues with, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.”
If you or someone you love is injured as a result of the negligence of a motorist, contact an experienced San Bernardino Personal Injury attorney who has been successful in fighting for the rights of injured pedestrians and will work aggressively to make sure you are compensated for your medical costs, pain and suffering and any other expenses incurred.

A 41-year old Sacramento man driving on Highway 247 near Barstow the other afternoon drifted into oncoming traffic. It is not known what caused him to do so.
As he approached oncoming traffic, he collided head-on with a 62-year old Barstow man driving a pickup truck. Both vehicles caught on fire.
The Sacramento man was pronounced dead at the scene. The other man was taken by air to a nearby hospital, where he died a few hours later.
Barstow police are investigating to determine why the man lost control and drifted into oncoming traffic, causing this fatal accident. Those of you out in the ocean this past weekend enjoying the beautiful weather might have seen the coast guard’s boat patrolling.
California and Federal marine law enforcement officers were out looking for boaters who may have had too much to drink. They were prepared to give possible drunken boaters a breathalyzer test and some boater education materials. In California, boating under the influence of alcohol is a crime which carries severe penalties that include jail and fines.
If a boater was caught with a blood alcohol level of more than the legal limit of 0.08%, they will face severe penalties. The end of June begins the boating season. Alcohol is more hazardous on the water than on land – the motion, engine noise and vibration accelerate a drinker’s impairment.
Last year, more than 300 arrests were made to boaters under the influence and over 4,000 citations were handed out. If you are facing a charge of boating while under the influence of alcohol or drugs, you are facing serious consequences. I suggest you contact an experienced San Bernardino Personal Injury attorney who has been successful in defending these types of cases.

The Hesperia Sheriff’s Department reported that a 40-year old man walking in the middle of the road the other evening died after being hit by two vehicles.
Hesperia Police received a telephone call saying that the driver just hit a man. After the vehicle hit him, a second vehicle also hit him, placing a second call to the Police.
Paramedics transported the man to a nearby hospital where he died.
Investigators believe that alcohol did not play a part in the accident; neither driver was arrested. The Hesperia Major Accident Investigation Team is investigating the incident and ask that anyone with information regarding this fatal accident to contact them.
I suggest they contact an experienced San Bernardino Personal Injury attorney to see if they are entitled to compensation for their loss.

A 32-year old woman, was on the north side of Highway 18 in Crestline a few months ago when an car accident took her life. She was driving behind a truck. A truck on the south side, sideswiped the truck on the north side causing his cargo, wooden roof trusses, to fly off the truck and crash through the windshield of the woman’s car. The woman lost control of the car, hit a stone pillar and ended up in an embankment. She died at the scene.
After an investigation, it was determined that the truck on the south side crossed the double yellow line when he waved to a friend on the side of the road. He may have been driving without a wide-load permit. The driver of the truck was charged with vehicular manslaughter and is awaiting a November hearing.
My condolences go out to the family of the woman.
