Every year thousands of construction workers are killed or seriously injured on the job even though many California and Federal regulations require safety measures to be implemented at the workplace. Construction sites can be a very dangerous place because of the heavy equipment and other hazards found there.
A 32-year old laborer died when he was struck in the head by a forklift bucket at a job site near Victorville.
The fatal accident happened while the crew was lining a waste water pond. Reports indicate that a forklift moving large rolls of liner struck the man. He was pronounced dead at the scene. There were no other injuries reported.
The San Bernardino County Sheriff’s Department and Cal/OSHA are investigating the death.
When a family loses a member to a work-related incident, they are left with questions about hazardous job conditions and other circumstances that caused their loved one’s death. The most important one is whether the company he worked for is responsible for his death and can be sued. The answer is yes.

Did you incur damages or injury at a construction site as a result of a third party – a contractor or perhaps a subcontractor? They could be held liable if you incurred these injuries from a mistake they made.
Too many workers are injured every year in a construction-type accident. What about those who work on a scaffold very high off the ground? Typical accidents that can occur in such a situation include collapsing equipment, a fall from high above, or electrical burns.
In many workplace accidents, employees or their survivors are limited to only worker’s compensation. The benefits do not pay for the loss of an individual, pain or suffering.
If you have lost a loved one in a work-related accident, contact an experienced San Bernardino Personal Injury attorney who will investigate the cause of the death to determine if there is an actionable and viable claim for negligence against the property owner or contractor and if so, will file a wrongful death lawsuit on your behalf. Do not delay; there is a statute of limitations to file your claim.
