A car chase that began in Pomona with speeds as high as 90 mph the other night ended in Fontana when a police dog bit a suspected 25-year old drunken driver.

 

When the suspect finally stopped his vehicle and officers approached him, he refused to show his hands, made aggressive movements and shouted obscenities at the officers.  It was at that time that the officers released the police dog that ended up biting the suspect and pulling him out of the car.  He was taken to a nearby hospital for treatment.

 

The suspect was then arrested and booked on suspicion of driving under the influence, felony evading and resisting arrest.

A Fontana couple, are charged with seven felony counts of allowing their five vicious pit-bull dogs to roam free and cause severe bodily injury to three small children.  A preliminary hearing on June 2 will determine if the couple should stand trial.

 

A woman and her four children were taking a walk near the railroad tracks in Fontana in February when the dogs attacked three of the children.  The dogs dug under a fence and got out.  A 5-year old girl, suffered broken ribs, a punctured lung, and bites on her arms, legs, neck and face.  She was placed on life support for a short time and then released from the hospital.  Her 6-year old brother needed over 200 stitches for leg wounds while their 7-year old sister, required 20 stitches for leg wounds.

 

A young neighborhood boy tried to help by throwing rocks at the dogs.  Police shot and killed one of the dogs and the other four were put to sleep.  What a sad story.  People need to make sure their dogs, especially potentially dangerous ones, are secure in their yard.

Today, many people take their dogs to a dog park for exercise and socialization.  California dog owners are responsible for the actions of their dog.  Most dog bites occur quickly and without warning.

A Fontana couple is facing seven felony counts for letting their five vicious dogs run loose – this incident led to the attack on three children out for a walk with their mother.  The children (ages 5, 6, 7) were severely injured with bite wounds, a broken rib cage and a punctured lung.  Animal control officers reported that the dogs were all pit bull mixes – one dog was shot and killed when it attacked a police officer.  The others have been euthanized.

 

Prosecutors believed the case warranted felony charges due to the seriousness of the injuries and circumstances of the attack on very small children. 

 

The man, pleaded not guilty while his wife, said she plans to surrender today.  The man is being held at the West Valley Detention Center in Rancho Cucamonga in lieu of $250,000 bail.  The man and the woman could face a maximum of seven years in prison. 

 

The mother of the children, had mixed feelings about the charges and said all she wanted was for justice to be served.  I hope the mother of the three children has contacted an experienced Personal Injury attorney; one who will make sure justice is served for her children.

The Journal of the American Medical Association reports that there are about 800,000 dog bites each year.  Some of the bites are severe enough to require a doctor’s care.

The weather, for the most part, is beautiful in San Bernardino.  I actually see individuals and couples walking outside all the time. But in some parts, there may be feral or abandoned dogs roaming about. One of my neighbors asked me what to do if she encounters a strange dog while out walking.

 

There are many things to do but never throw anything at the dog or scream at it.  This may make the dog angry and excite it.  Avoid making eye contact but never turn your back on it.  If the dog looks like it will attack you, give it your jacket, purse or backpack.  Create a barrier between the two of you.  If you are knocked down, curl into a ball, protecting your ears and the back of your neck.  Other safety tips include not to pet a dog tied up in its yard by reaching through the fence, do not bother a dog that is eating, do not pull its ears or tail, and always let the dog see you first.

 

If the dog bites you, as soon as possible, wash the wound with soap and water and call your doctor.  Contact your local animal control agency at San Bernardino County Animal Care and Control Program (800-472-5609).

A young man came into the office this week.  He had been attacked by his friend’s large breed dog several years back. This dog had crushed his forearm tearing muscles and severing nerves.  He had to have reconstructive surgeries for his injuries.  But he had been so conflicted about suing his friend for damages that he never contacted a lawyer.  His injury affected his work and his ability to obtain new work.  Still, he didn’t make a claim, because he didn’t think that his buddy could afford it.  But very recently, he had a falling out with the dog’s owner and came looking to me for assistance.

This young man’s situation is terrible, but in ways that may not be obvious. Although the law is clear that the owner of the dog is responsible for any damage or injuries it does. There is also a clear statute of limitations, or a time limit, of when a claim can be filed after the date of the initial injury.  For most personal injury claims, it’s two years after the accident.  It was too late for this young man to file a claim.  Secondly, what he didn’t know is that in many cases, the dog owner’s homeowners insurance policy’s general liability provision can cover this type of claim. His concern over his friend’s financial status may have been unnecessary. This is why it is so important to speak to an experienced dog bite attorney immediately after the injury occurs.  The young man could have had a very different experience had he spoken to me early on.
